These Terms govern your use of matchmyacres.com and our related services (the "Service"). By using the Service or submitting a profile, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

1. Who we serve

The Service is for owners, or people authorized to act for owners, of land located in Michigan or Indiana. Territory: Michigan and Indiana only; MatchMyAcres does not accept landowners, parcels, or projects located in any other state. Eligibility is determined by where the land or project is physically located, not by where any person or company lives or is organized. If a parcel or project crosses a state line, only the portion located in Michigan or Indiana is eligible. You must be at least 18 years old.

Out-of-state waitlist. If your land is outside Michigan and Indiana, you may join our separate waitlist. You give only your email, state, and county. Joining the waitlist is not use of the Service, an application, or an offer, and it is not a promise that we will ever expand to your state. We do not share waitlist entries with developers, and developers will not contact you through the waitlist. See our Privacy Policy, §5B.

2. What we do — we introduce, you decide

MatchMyAcres is an online platform. Landowners publish information about their own land and their terms. Energy and infrastructure developers that subscribe to our platform may view that information and ask to be introduced. Developer subscriptions are not open yet; until they open, no developer can view any profile information. We share your contact information with a developer only after you approve that specific developer. After an introduction, you and the developer deal with each other directly.

What developers can see. You publish your own profile and control it. You can edit it or withdraw it at any time. Before you approve anyone, subscribing developers see only an anonymous summary: state, county, an acreage range, the project and deal types you're open to, a general timeframe, and a note that you published the profile. They never see your name, contact details, address, parcel IDs, township/section, exact acreage, your notes, or any rates or terms you mentioned. In small counties we may widen the acreage range or show only the state. Approval is per developer and per project. You see which developer is asking and for which project, and then you decide.

We are not a real estate broker, salesperson, agent, or attorney, and we do not represent you or any developer. We do not:

  • negotiate, propose, or relay rates, rents, prices, or any other terms;
  • recommend or evaluate any offer;
  • value your land or provide a market analysis of it;
  • list or market your land on your behalf;
  • prepare, review, or sign agreements, or handle any payments.

Nothing on the Service is legal, tax, financial, or real estate advice. Before you sign any lease, easement, option, or purchase agreement, consider hiring your own attorney and tax advisor.

3. How we're paid

It's free for landowners. You never pay MatchMyAcres anything. When developer access opens, developers will pay us a flat subscription or advertising fee to use our platform. We do not currently charge developers. That fee will be the same whether or not you, or anyone, ever signs a lease, easement, option, or sale. We don't get paid more when a deal happens, and we take no commission, success fee, or share of any payment to you. Our fee is not a deduction from, or a line item in, any payment to you. We don't set or control what a developer offers you, so compare offers and get your own advice.

4. Our principal's other work (conflict disclosure)

Nick Merry, who runs MatchMyAcres, also works separately as a contract land agent for energy and infrastructure developers. In that work he represents the developer, not landowners. That work is separate from MatchMyAcres. He doesn't use MatchMyAcres landowner information for it, and he doesn't act as a land agent on land whose owner came to us through MatchMyAcres. If a developer you're asked to approve is, or in the last 24 months was, one of his land-agent clients, we'll tell you before you decide.

5. No obligation; no guarantee

You never owe MatchMyAcres anything. You may decline any introduction, and you may withdraw your profile at any time. We don't guarantee that any developer will contact you, make an offer, or offer any particular rate, or that any project will be built. Any agreement you choose to sign with a developer is between you and that developer. It binds you on its own terms, and we are not a party to it.

6. Your responsibilities

You agree that:

  • (a) you own the land you describe, or are authorized to act for its owner(s);
  • (b) the information you submit is accurate, and you'll keep it current;
  • (c) you won't submit information about land you don't own or control, or other people's personal information without their permission;
  • (d) you won't misuse the Service, including by scraping, spamming, introducing malicious code, or attempting unauthorized access.

You are responsible for your own decisions and dealings with developers.

7. Developers are independent

Developers are independent businesses. They are not our agents. We don't endorse any developer, project, or offer, and we aren't responsible for what developers say or do. Our agreements with developers prohibit them from reducing your compensation because of our fee, require them to use your information only for the project you approved, and require them to follow calling and texting laws. We can't guarantee their compliance. Please report concerns to hello@matchmyacres.com.

8. Calls, texts, and emails

Contacting you is optional. On our form, you may check an optional, unchecked box to let us call and text you. You don't have to agree in order to submit a profile or use the Service.

☐ I agree that MatchMyAcres (Michael Scott Land Company LLC) may call and text me at the number I provided, including with automated technology and prerecorded messages, about my land and potential projects. Consent is not required to submit this form or to use our service. Message frequency varies; msg & data rates may apply. Reply STOP to opt out, HELP for help. See our Privacy Policy.

Separate consent for each developer. When you approve an introduction, you'll be asked separately whether that developer may contact you:

☐ I approve sharing my information with the developer named on the approval request and agree that that developer may call and text me, including automated, about the project named on the approval request. Not required. I can opt out at any time.

You can withdraw consent at any time by replying STOP, emailing hello@matchmyacres.com, or telling us any other reasonable way. We'll honor your request promptly, and within the time the law requires. If you consent to MatchMyAcres contacting you, that does not by itself give consent to any developer.

9. Maps and data — provided "as is"

Map data comes from public sources: the USGS/LBNL U.S. Wind Turbine Database, U.S. EIA Form 860M, MISO and PJM interconnection queues, the U.S. Census, and © OpenStreetMap contributors. It is provided "as is," without warranty of accuracy, completeness, or timeliness. Data may be out of date, and locations are approximate. Interconnection-queue entries are proposals, and many never get built. Nothing on our maps or pages means that any project will be built, that any developer wants your land, or that you'll receive an offer. No source agency endorses MatchMyAcres. We never show landowner names, parcels, or locations publicly. Figures or examples on the Service are illustrative only.

10. Our content and name

The Service and its content (other than public data and your submissions) belong to Michael Scott Land Company LLC. MatchMyAcres™ is our trademark. You give us a non-exclusive license to use what you submit to operate the Service as described in these Terms and our Privacy Policy. We will not publish your name, contact details, address, or parcel IDs.

11. Disclaimer of warranties

TO THE FULLEST EXTENT THE LAW ALLOWS, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, MATCHMYACRES AND ITS MEMBERS, MANAGERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST LEASE OR EASEMENT PAYMENTS, OR LOST OPPORTUNITIES, ARISING FROM THE SERVICE, ANY DEVELOPER, OR ANY AGREEMENT YOU ENTER WITH A DEVELOPER. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO $100. Because the Service is free to landowners, this limit reflects that. These limits don't apply where the law doesn't allow them, including liability for fraud, gross negligence, or willful misconduct.

13. Indemnity

You agree to indemnify us against third-party claims arising from information you submit that is false or that you weren't authorized to submit, or from your breach of these Terms.

14. Disputes

(a) Talk to us first. Before filing any claim, email hello@matchmyacres.com with a description. We'll both try in good faith to resolve it within 30 days.

(b) Governing law. Michigan law governs these Terms, without regard to conflict-of-law rules, except where federal law applies.

(c) Where to sue. Any claim must be brought in the state or federal courts located in Oakland County, Michigan, and you and we consent to their jurisdiction. Either party may bring a qualifying claim in small-claims court in the county where you live.

(d) Time limit. To the extent the law allows, any claim must be brought within one year after it arises.

(e) Individual claims. To the extent the law allows, claims are brought individually, not as a class representative.

15. Changes, termination, general

  • We may update these Terms. We'll post the new version with a new effective date, and we'll notify you by email for material changes. Continued use means you accept the changes.
  • You may stop using the Service at any time. We may suspend or end access for misuse.
  • These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Service. If any part is unenforceable, the rest stays in effect. Not enforcing a provision isn't a waiver of it. You may not assign these Terms. We may assign them to a successor.
